Your order is not accepted until Marasouq confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as Marasouq may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.

Marasouq’s names, logos, product and service names, designs, and slogans are trademarks of Marasouq or its affiliates or licensors. You must not use such trademarks without the prior written permission of Marasouq. Shopify’s name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input.

You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Marasouq.

We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.

أسماء Marasouq وشعاراتها وأسماء منتجاتها وخدماتها وتصميماتها وشعاراتها هي علامات تجارية لـ Marasouq أو الشركات التابعة لها أو المرخصين. يجب ألا تستخدم هذه العلامات التجارية دون الحصول على إذن كتابي مسبق من Marasouq. اسم Shopify وشعارها وأسماء منتجاتها وخدماتها وتصميماتها وشعاراتها هي علامات تجارية لـ Shopify. جميع الأسماء والشعارات وأسماء المنتجات والخدمات والتصميمات والشعارات الأخرى على الخدمات هي علامات تجارية لأصحابها.

القسم 7 - الأدوات الاختيارية
قد يتم تزويدك بإمكانية الوصول إلى أدوات العملاء التي تقدمها أطراف ثالثة كجزء من الخدمات، والتي لا نراقبها ولا نملك أي سيطرة أو مدخلات عليها.
أنت تقر وتوافق على أننا نوفر الوصول إلى هذه الأدوات "كما هي" و"كما هي متاحة" دون أي ضمانات أو تمثيلات أو شروط من أي نوع ودون أي تأييد. لن نتحمل أي مسؤولية على الإطلاق تنشأ عن أو تتعلق باستخدامك للأدوات الاختيارية التابعة لجهات خارجية.
أي استخدام من قبلك للأدوات الاختيارية المقدمة عبر الموقع يكون على مسؤوليتك الخاصة بالكامل ويجب عليك التأكد من أنك على دراية بالشروط التي تقدم بها الأدوات من قبل مزود الطرف الثالث ذي الصلة وتوافق عليها.
قد نقدم أيضاً، في المستقبل، ميزات جديدة من خلال الخدمات (بما في ذلك إصدار أدوات وموارد جديدة). تعتبر هذه الميزات الجديدة أيضاً جزءاً من الخدمات وتخضع لشروط الخدمة هذه.

القسم 8 - روابط الطرف الثالث
قد تحتوي الخدمات على مواد وروابط تشعبية لمواقع ويب مقدمة أو مدارة من قبل أطراف ثالثة (بما في ذلك أي وظائف مضمنة لجهات خارجية). نحن غير مسؤولين عن فحص أو تقييم محتوى أو دقة أي مواد أو مواقع ويب تابعة لجهات خارجية تختار الوصول إليها. إذا قررت مغادرة الخدمات للوصول إلى هذه المواد أو مواقع الطرف الثالث، فإنك تفعل ذلك على مسؤوليتك الخاصة.

يعمل Marasouq بواسطة Shopify، مما يمكننا من تقديم الخدمات لك. ومع ذلك، فإن أي مبيعات ومشتريات تقوم بها في متجرنا تتم مباشرة مع Marasouq. باستخدامك للخدمات، فإنك تقر وتوافق على أن Shopify غير مسؤولة عن أي جانب من جوانب أي مبيعات بينك وبين Marasouq، بما في ذلك أي إصابة أو ضرر أو خسارة ناتجة عن المنتجات والخدمات المشتراة. أنت بموجب هذا تُعفي صراحةً Shopify والشركات التابعة لها من جميع المطالبات والأضرار والمسؤوليات الناشئة عن أو المتعلقة بمشترياتك ومعاملاتك مع Marasouq.

القسم 10 - سياسة الخصوصية
تخضع جميع المعلومات الشخصية التي نجمعها من خلال الخدمات لسياسة الخصوصية الخاصة بنا، والتي يمكن عرضها هنا، وقد تخضع بعض المعلومات الشخصية لسياسة خصوصية Shopify، والتي يمكن عرضها هنا. باستخدامك للخدمات، فإنك تقر بأنك قد قرأت سياسات الخصوصية هذه.

القسم 11 - التعليقات والملاحظات
إذا قمت بإرسال أو تحميل أو نشر أو إرسال بالبريد الإلكتروني أو نقل أي أفكار أو اقتراحات أو ملاحظات أو مراجعات أو مقترحات أو خطط أو محتوى آخر (يُشار إليها مجتمعة بـ "الملاحظات")، فإنك تمنحنا ترخيصاً دائماً وعالمياً وقابلاً للترخيص من الباطن وخالياً من حقوق الملكية لاستخدام هذه الملاحظات ونسخها وتعديلها ونشرها وتوزيعها وعرضها في أي وسيط ولأي غرض، بما في ذلك للاستخدام التجاري.

القسم 12 - الأخطاء وعدم الدقة والسهو
قد تكون هناك أحياناً معلومات على الخدمات أو فيها تحتوي على أخطاء مطبعية أو عدم دقة أو سهو قد يتعلق بأوصاف المنتجات أو التسعير أو العروض الترويجية أو العروض أو رسوم شحن المنتجات أو أوقات العبور والتوفر. نحتفظ بالحق في تصحيح أي أخطاء أو عدم دقة أو سهو، وتغيير أو تحديث المعلومات أو إلغاء الطلبات إذا كانت أي معلومات غير دقيقة في أي وقت دون إشعار مسبق (بما في ذلك بعد تقديم طلبك).

القسم 13 - الاستخدامات المحظورة
يجوز لك الوصول إلى الخدمات واستخدامها لأغراض قانونية فقط. لا يجوز لك الوصول إلى الخدمات أو استخدامها، بشكل مباشر أو غير مباشر: (أ) لأي غرض غير قانوني أو ضار؛ (ب) لانتهاك أي لوائح أو قواعد أو قوانين دولية أو فيدرالية أو إقليمية أو حكومية أو محلية؛ (ج) للتعدي على حقوق الملكية الفكرية الخاصة بنا أو بالآخرين أو انتهاكها؛ (د) لمضايقة أو إساءة أو إهانة أو إيذاء أو تشويه سمعة أو افتراء أو تحقير أو ترهيب أو إيذاء أي من موظفينا أو أي شخص آخر؛ (هـ) لنقل معلومات كاذبة أو مضللة؛ (و) لإرسال أو استلام أو تحميل أو تنزيل أو استخدام أو إعادة استخدام أي مواد لا تتوافق مع هذه الشروط عن علم.

القسم 14 - الإنهاء
يجوز لنا إنهاء هذه الاتفاقية أو وصولك إلى الخدمات (أو أي جزء منها) وفقاً لتقديرنا الخاص في أي وقت دون إشعار، وستظل مسؤولاً عن جميع المبالغ المستحقة حتى تاريخ الإنهاء.

القسم 16 - حدود المسؤولية
إلى أقصى حد يسمح به القانون، لن تكون Marasouq أو شركاؤنا أو مديرونا أو مسؤولونا أو موظفونا أو الشركات التابعة لنا أو وكلاؤنا أو مقاولونا أو مزودو الخدمات أو المرخصون لنا، أو تلك الخاصة بـ Shopify والشركات التابعة لها، مسؤولين في أي حال من الأحوال عن أي إصابة أو خسارة أو مطالبة، أو أي أضرار مباشرة أو غير مباشرة أو عرضية أو عقابية أو خاصة أو تبعية من أي نوع.

القسم 17 - التعويض
أنت توافق على تعويض والدفاع عن وإبراء ذمة Marasouq وShopify والشركات التابعة لنا وشركائنا ومسؤولينا ومديرينا وموظفينا ووكلائنا ومقاولينا ومرخصينا ومزودي الخدمات من أي خسائر أو أضرار أو مسؤوليات أو مطالبات، بما في ذلك أتعاب المحاماة المعقولة.

القسم 18 - قابلية الفصل
في حالة تحديد أن أي حكم من أحكام شروط الخدمة هذه غير قانوني أو باطل أو غير قابل للتنفيذ، يظل هذا الحكم قابلاً للتنفيذ إلى أقصى حد يسمح به القانون المعمول به.

القسم 19 - التنازل؛ الاتفاقية الكاملة
لا يشكل فشلنا في ممارسة أو إنفاذ أي حق أو حكم من أحكام شروط الخدمة هذه تنازلاً عن هذا الحق أو الحكم.

القسم 21 - القانون الحاكم
تخضع شروط الخدمة هذه وأي اتفاقيات منفصلة نقدم بموجبها الخدمات لك وتُفسر وفقاً للمحاكم الفيدرالية ومحاكم الولاية أو الإقليمية في الولاية القضائية حيث يقع مقر Marasouq.

القسم 22 - العناوين
العناوين المستخدمة في هذه الاتفاقية مدرجة للراحة فقط ولن تحد أو تؤثر بأي شكل آخر على هذه الشروط.

القسم 23 - التغييرات على شروط الخدمة
يمكنك مراجعة أحدث إصدار من شروط الخدمة في أي وقت على هذه الصفحة.
نحتفظ بالحق، وفقاً لتقديرنا الخاص، في تحديث أو تغيير أو استبدال أي جزء من شروط الخدمة هذه عن طريق نشر التحديثات والتغييرات على موقعنا الإلكتروني. تقع على عاتقك مسؤولية التحقق من موقعنا الإلكتروني بشكل دوري للتغييرات. استمرارك في استخدام أو الوصول إلى الخدمات بعد نشر أي تغييرات على شروط الخدمة هذه يشكل قبولاً لتلك التغييرات.
